We recently sent a candidate of Colors! 3D to Nintendo, and they are now having a team that goes through the product in detail. The submission is a scary time for any developer, as you can never be sure how it’s going to go. Either Nintendo gives the all-clear, which for Colors! 3D means that it could be in the store a few weeks, or they come back with a list of proposed (or more often required) changes. If that happens, you have to make those changes, and then the process restarts.
Talk about severely lacking publicity... even after a short glance at their website, Facebook, and Twitter, I have absolutely no clue what this is about.

That's what I've been wondering about (in secret ): Can homebrew (like using LibNDS or whatever) be accepted by Nintendo and placed into the e-Shop, or even as full, brick & mortar store releases?
I believe they would recode it to official SDKs, Nintendo would probably never accept "homebrew" coded on libraries that are supposed to be FREE and opensource It would be double law-break

Colors on the DS was a great application but with 3 layers to paint on, there are going to be some real gems on this. I personally like visiting the colors gallery every now and then and looking at what everyone has created.
The download for the DS homebrew version seems to have vanished from the colors site now (unsurprisingly) but you can still download it from our download center for those that have never heard of it:
There is a new trailer in 3D on the eShop since today, and it looks totally rad! And retrohead, it's actually five different depth layers you can paint on. Go watch the trailer right now folks, it is nothing short of awesome!
