So i see this game and notice it was made by the guys who done Truckers Delight. I grab it and start playing and the first level is called "Path of Piracy" and i was like hmmmm...
Continued playing for a couple of minutes and then this robot voice starts randomly saying "Hello pirate" "its been a long time" "there is no way out" "your efforts are useless" "there is only one way to play this game" "you need to buy the game" etc etc. Then a push notification pops up saying "Dear pirate, please buy the game if you like it. Thanks for your support!"
Once you click go it takes you to the app store and closes the game lol. I actually might buy it later because it seemed pretty good for the price they was asking anyway.
I was always thinking why they don't do anything like that with NDS games. Only this Michael Jackson game from Ubisoft was a bit like that. But maybe Nintendo told them not to do anything like that ("You are a pirate") because of the kids.

I think there's other game like in nds there's LovePlus+ where if you play without ap patch, the girl will reject you everytime you take her to date. there's some other games too using similar way to protect the game, like it will pop up random message and close the game like EDGE did, or making game impossible to be played like DQM 2 did.
Yes, some NDS games won't work at all, some switch to "demo mode". But never a game said: You're a pirate. That'd be fun.
But we have so much warez-daddies that buy a m3 or supercard for their kids, the kids wouldn't understand that. So maybe that's the reason why they don't do that.
hmm you know It reminds me with a pc games that did the same thing like that EDGE game... I forgot what game it is... but it's pretty old and controversial, just because the same message as that EDGE game :p
