My vote goes to Phantasy Star Zero. The gameplay is good, it is enjoyable, easy to understand and the menu is very easy to navigate (some games have menu, submenu, "subsubmenu", "subsubsubmenu" ); the graphics and sound are nice; the developers also seem to like cats...
not about limiting to west games only, but DQ 5 is on Japan at 2008, Layton 2 too at 2008. So I not count it to 2009 games, I'm not saying Kingdom Hearts 358/2 Days, Mario & Luigi: Bowser's Inside Story, Phantasy Star Zero is not in right? or Scribblenauts, Shin Megami Tensei: Devil Survivor, The Legend of Zelda: Spirit Tracks right?
Pokemon too is from 2008, plus it's just reboot from 2007 with additional story. why not putting Dragon Quest 9, a real sequel, even if it's still for Japanese only?

IMO Dragon Quest 5 is NES game, not 2009, and it's remake, a full remake, not reboot and so-on Layton 2 is not 2009
so it's GTA CW, seriously, I'm not the fans of GTA, but GTA works with everyone, male, female, kids, oldies, slaves, presidents, etc lol
Actually, the original DQ5 is NOT from NES, it is from SNES. And this one is actually is a more or less like the downgraded PS2 version of DQ5, which in another word is actually a full remake. And this DS one is the only version of DQ5 got released offically in english I think.

Sure you´re right, kesadisan, but then you´d have to put Infinite Space and SMT: Strange journey in here too. But for people like me who have to wait for english releases these games can´t be taken into consideration due to language limitations. I´ve played them partly, but to really vote on them I just have to understand more of it. So this poll should maybe be called "best english released game of 2009", that would be alright with me as English is the language established here at ds-scene?
For my vote: all of these games are very high standard titles, I really enjoyed all of them. So I´ll go with the game I couldn´t put aside until I finished it, which has to be.... (drumroll) Chinatown Wars. Yeah, not really innovative, but god was that addictive

More to the point, it's not a port. Even if it were a port, I think it would still deserve to be on the list because sometimes that's the best game to come out in any given year. I mean, Chrono Trigger was an absolutely fantastic game and I can totally see someone saying that was 2009 game of the year. You know, in Europe.

Yeah, Layton and the Diabolical Box came out in 2007, so I think the only rule is that the game was released somewhere for the first time this year.
EDIT: ZOMG **ひらめき** I just remembered GOTY 2009: Inazuma Eleven 2!! Bar none, this was the most incredible game of 2009!

I do understand the word Remake, and in fact, you are the one who don't understand the difference between Ramake and Port. DQ5 on PS2 and DS is a remake, since the entire game has been fully rewritten from scratch. And on the other hand, as the other already pointed out, Chrono Trigger DS is a port. It is the exact the same SNES version with enhanced gameplay.
