With the 2.0b1 update from Gateway you can emulate your current 3DS firmware. Booting into this emulated firmware, you can safely update to the latest firmware.
From there you can access the eShop and download games. I haven't tried download legal games in the emulated firmware, but I have seen other users confirm this works.
